A Macon man is charged with felony domestic assault after an incident last week at a Macon residence, according to court records filed in Macon County Circuit Court.
David Gwinner, 58, of Macon, is charged with domestic assault in the second degree, a class D felony, in a complaint filed Aug. 15 by Macon County Prosecuting Attorney Joshua Meisner. The charge stems from an incident alleged to have occurred Aug. 14.
According to a probable cause statement written by Macon Police Officer Caleb Wagahoff, officers responded at about 1:30 p.m. Aug. 14. Wagahoff wrote that Gwinner and a woman identified in court records by her initials had been having a verbal argument, and that the woman told him Gwinner grabbed her by the throat and threatened to choke her if she did not listen to what he had to say.
The woman indicated with her right hand that Gwinner had grabbed her with one hand around her neck, Wagahoff wrote. The officer reported observing a red mark on the left side of her neck, and wrote that she said the mark came from Gwinner putting his hands on her. The two live at the same residence, according to the statement.
Wagahoff wrote that after being read his Miranda rights, Gwinner admitted grabbing the woman’s throat but said he did not squeeze it. According to the statement, Gwinner said he placed his palm against her, with his palm underneath her chin.
A judge found probable cause and issued a warrant for Gwinner’s arrest on Aug. 15. Bond was set at $10,000, cash only, with a condition of no contact with the alleged victim. Court records show the warrant was served the same day in Macon County.
Second-degree domestic assault is punishable by a term of up to seven years in prison.
