A La Plata woman was arrested as a fugitive from justice after a records check turned up an out-of-state felony warrant, according to Macon County court records.
Kristy L. Lumpkins is charged in Macon County Circuit Court with being a fugitive from out of state, a felony, in case 26MA-CR00178. Prosecuting Attorney Joshua Meisner filed the charge June 17.
Lumpkins waived extradition and is set to be returned to Barton County, Kansas, to answer the charge.
According to a probable cause statement by La Plata Police Chief Jason D. Bunch, officers were dispatched to a domestic dispute about 7 p.m. June 16. During the call, a records check through Macon County Enhanced 911 turned up a warrant out of Barton County, Kansas, charging Lumpkins with one count of aggravated incest. She was taken into custody and held at the Macon County Sheriff’s Office, the statement says.
The Kansas warrant sets bond at $100,000 and seeks her return to Barton County to answer the charge, court records show.
On June 18, Lumpkins appeared before Judge Kristen Dawn Burks and signed a waiver of extradition, consenting to return to Kansas, according to court records. The waiver states she signed it of her own free will; she appeared without an attorney.
The charge is an allegation that has not been proven in court, and a defendant is presumed innocent unless and until proven guilty.
